Appreciated for his honesty and practical legal advice, Mark consistently delivers utilitarian solutions that help his clients resolve disputes and litigation efficiently and economically.

Mark offers broad experience in virtually all phases of IP counseling and litigation. He understands and has represented clients involved in a wide range of technologies, including high barrier specialty packaging films, bulk material handling systems, cardiac marker immunoassays, high speed packaging machinery and electrochemical sensors, to name only a few.

Mark provides businesses with IP enforcement, protection and counseling on a local, regional and national scale. He has successfully litigated claims in federal courts involving patents, trademarks, trade dress and trade secret disputes. He works to aggressively advocate client positions in complex litigation to achieve client goals.

Mark is dedicated to resolving litigation at the earliest stage possible in order to conserve his client’s time and resources. He is known for consistently developing unique strategies that best fit his client’s needs, whether by settlement, design change, mediation or court battle. His advocacy is grounded in an unwavering determination to help clients get through even the most difficult conflict.

An engineer by training, Mark is at his best when challenging and defending the science and technology underlying IP. He understands the most subtle nuances of sophisticated products and ground-breaking creativity, and is able to keep pace when discussing even the most esoteric features of cutting-edge innovation. Mark’s technical insight, industry acumen and legal know-how provide his clients with a holistic approach to their challenges.

Prior to joining the firm, Mark served as associate counsel at Velsicol Chemical Corporation, handling matters related to all corporate activities. Later, he was associate counsel with Hercules Incorporated, a global manufacturer of chemical specialties used in making products for home, office and industrial markets. At Hercules, he advised on patent matters related to water treatment chemicals, hydrocarbon processing products, rheology modifiers and paper chemicals. During law school, Mark also worked with Indiana University’s trademark office..

  • Cardiac Marker Immunoassay: Represented a large, multi-national medical diagnostic products company in regard to patent infringement claims concerning point-of-care immunoassay products. The case was resolved favorably prior to trial in light of strong patent invalidity defenses.
  • Multilayer Barrier Food Packaging: Defended a manufacturer of high-barrier, multilayer food packaging films in a patent infringement matter, including the successful defense of a preliminary injunction motion. The case settled favorably prior to trial.
  • Bulk-material Handling Dust Control Systems: Represented a designer and manufacturer of dust control systems for bulk material handling systems in the defense of patent infringement claims tried to a jury. Tried inequitable conduct in a subsequent bench trial. The three asserted patents were found invalid and/or not infringed, and all three were rendered unenforceable due to inequitable conduct.
  • Pressure Sensitive Adhesives. Defended a large, multi-national manufacturer of plastics products in a patent infringement matter regarding planetary roller extruder adhesive compounding. Obtained a jury verdict of no infringement and judgment as a matter of law of patent invalidity.
  • Mobile, Expandable Shelters: Represented a manufacturer of mobile expandable shelters in a 28 U.S.C. §1498 infringement claim against the United States. After obtaining favorable claim construction, the matter was favorably resolved by a seven-figure judgment against the United States.
  • Differential Pressure Gages: Prosecuted claims of trademark, trade dress and copyright infringement on behalf of national manufacturer of measurement devices and obtained a jury verdict of infringement.
  • Automotive Interiors: Represented an OEM manufacturer in a patent infringement action brought against a competitor relating to the manufacture of automotive interior panel skins.
  • Hair Clippers: Defended a globally-known manufacturer of hair cutting products against patent infringement and trade secret misappropriation claims. Obtained a judgment of no infringement, patent invalidity and patent unenforceability due to inequitable conduct and an award of attorney fees.
