Tony brings experience as a white collar and healthcare fraud prosecutor for the U.S. Department of Justice’s Fraud Section, as well as nearly a decade advising large corporate clients on complex legal and compliance issues and litigation. He has worked as a part of a federal monitor team for a large international medical device maker and has overseen the monitorship of a large national healthcare company while at the DOJ. This experience working with compliance programs and issues on both sides of the table gives him a unique perspective on building and operating successful compliance programs.
He has significant criminal and civil trial experience, both defending and prosecuting those accused of white collar and healthcare fraud offenses. In addition, Tony routinely conducts internal investigations and responds to government investigations arising out of alleged violations of federal and state healthcare fraud statutes, wire fraud and other types of financial crimes, including market manipulation and crimes related to the trading of commodities.
Tony has helped numerous clients, including government contractors, defend against civil investigations arising out of federal and state False Claims Acts. Tony’s experience defending clients against allegations under the federal False Claims Act include defending a large national healthcare company in a wide-ranging investigation based on whistleblower complaints, assisting a physician in dismissing FCA complaints against him, and helping a large international manufacturer in reaching a favorable settlement of a reverse false claims action related to trade tariffs.
Tony also assists clients with complex issues related to compliance and internal controls. Specifically, Tony helps clients build compliance programs from the ground up, improve well-established compliance programs, and investigate and analyze potential compliance issues.
Throughout his career, Tony has served as a trusted adviser to healthcare providers and suppliers of all sizes on issues of regulatory compliance and in antitrust investigations. Tony has advised some of the largest healthcare companies in the world on state and federal regulations in the healthcare industry, including the Anti-Kickback Statute, the Stark law and other key regulatory issues.
Additionally, he has represented clients in multiple investigations conducted by the Environmental Protection Agency (EPA) and the DOJ for violation of criminal and civil environmental regulations.
As a result, Tony has provided clients with a variety of different services in this area, including obtaining an advisory opinion from the Office of Inspector General at the U.S. Department of Health and Human Services (HHS-OIG), monitoring ongoing compliance of key business initiatives, conducting regulatory due diligence on acquisitions, mergers and new initiatives, and submitting self-disclosures to HHS-OIG and the Centers for Medicare and Medicaid Services related to possible violations of the Anti-Kickback Statute and Stark law.
