John Kelly, partner and chair of Barnes & Thornburg’s Healthcare Department and Healthcare Industry Practice (HIP), and Tony Burba, healthcare partner and HIP member, will be presenting at the American Health Law Association’s (AHLA) 2024 Fraud and Compliance Forum.

As chair of the planning committee for this year’s forum, John Kelly will present the opening session, “The Loper Bright Decision and What it Means for Health Care,” on Oct. 28, covering the landmark Supreme Court decision in the Loper Bright case and the elimination of the Chevron deference. He is also presenting “There’s Still a Pulse: The Government Resuscitates Managed Care Enforcement and Oversight” on Oct. 29, which will discuss key trends in managed care enforcement and risk areas for plans, management services organizations (MSOs), and providers; suggestions on how to manage risk from a compliance perspective; and focus areas and recent takeaways from the HHS-OIG.

Tony Burba is presenting “Current Trends in Lab Enforcement” on Oct. 29. His presentation will cover recent developments in the enforcement of the Anti-Kickback Statute (AKS) and Eliminating Kickbacks in Recovery Act (EKRA) in lab cases; genetic testing schemes and COVID testing fraud; recent cases involving telehealth and lab marketing, along with a look at AI in the lab industry; cases involving independent contractors and the risk of in-office personnel; and urinary drug screening and addiction recovery fraud.

The AHLA Fraud and Compliance Forum is designed to serve as both a crash course for advisers just entering the healthcare industry and a deep dive for experienced advocates seeking new strategies. The two-and-a-half-day forum features sessions led by fraud and compliance professionals who work with a wide variety of health care providers as well as presenters from federal health care fraud regulatory and enforcement agencies.
