Patent Linkage Opens in China: Dispute Mechanisms and Enforcement Best Practices

China’s National Intellectual Property Administration (CNIPA) and National Medical Products Administration (NAMPA) recently promulgated a new final rule for disputes involving drug patents.

The Measures for Implementation of Early Resolution Mechanisms for Drug Patent Disputes (Trial) implements patent linkage in China and went into effect on July 4, 2021. Almost simultaneously, the Supreme People’s Court and the CNIPA published their final rules on how to hear patent dispute cases connected to the patent linkage through civil action and administrative adjudication, effective July 5. This session on the new patent linkage system will outline its mechanisms and their enforcement, and provide considerations for innovator drug companies.
