As lead counsel for the state, Tim was responsible for investigating and finding admissible evidence against defendants, crafting pleadings and briefs, conducting trials and, if trial was averted, conducting and finalizing settlement documents.
Tim has prosecuted and defended complex environmental cases in administrative, state, and federal tribunals, including cases before the Indiana Court of Appeals and the U.S. Court of Appeals. He successfully asserted the state’s environmental claims in bankruptcy courts throughout the U.S. to fund millions of dollars in cleanup obligations in Indiana.
His litigation experience includes federal and state regulation of the land, water and air, including Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) sites, surface mining sites, floodways, dams, and asserting natural resource damage claims.
Immediately prior to joining the firm, Tim was counsel for the Site 0153 Superfund Alternative Project, where he assisted the Indiana Department of Environmental Management (IDEM) in successfully implementing a state-funded Superfund cleanup, thus removing the threat of EPA placing the site on the National Priorities List.
