As a creditors’ rights and bankruptcy attorney, Talia Wagner works with lenders and unsecured creditors’ committees on Chapter 11 cases, real estate and asset-based financings, term loans, lines of credit, letters of credit, revolving credit facilities and franchise financing. Talia advises borrowers on practical ways of navigating distressed situations, including sales, liquidations and bankruptcy proceedings.

Notably, Talia represents clients in connection with plan confirmation issues, asset purchases, negotiation of cash collateral orders, and claim objections. She handles complex insolvency and business disputes, often involving stay litigation, fraudulent transfer litigation, and preference litigation.

Talia has litigated before the Eleventh Circuit Court of Appeals, numerous U.S. district courts, bankruptcy courts, and state courts in Georgia and across the country.

Prior to joining the firm, Talia was an associate in the bankruptcy and restructuring group of an Atlanta-based law firm.

EXPERIENCE
Experience
  • Represented lender in connection with three related bankruptcy cases involving loan secured by lumber yard in North Georgia involving multiple chapter 11 cases and plans of reorganization. Following defaults under the various plans, represented client in connection with the subsequent sale of its collateral, pursuit of guarantors, and subsequent bankruptcy cases*
  • Represented Chapter 11 trustee for grading company in connection with bankruptcy of grading company, including advising as to ongoing operations of debtor and multiple state court claims filed by and against debtor, which were removed by bankruptcy court*
  • Represented Chapter 11 trustee of five affiliated debtors, in adequate protection order and replacement lien granted to a judgment lien creditor, contested sale issues, and multiple appeals filed former manager of debtors*
  • Represented hospitality lender in multiple matters secured by franchised hotels, including workouts, bankruptcy cases and other litigation*
  • Represented debtors’ former CEO and outside board member in connection with adversary proceeding alleging breaches of fiduciary duty and seeking recovery of all compensation and bonuses under a theory of fraudulent transfer, arising from debtors’ conduct of business with affiliated entities, which plaintiff contends breached the directors’ and officers’ duties to debtors*
