We’re Open! NLRB Still Operating During Government Shutdown


During a government shutdown a few years back, the National Labor Relations Board (NLRB) was closed for business. That resulted in the delay of processing new and pending cases at the agency. It’s a different story this time around, however, as the labor board remains open and running at full capacity despite the current government shutdown. While the Equal Employment Opportunity Commission is closed, the NLRB is operational and has plans in place in the event funding ceases.

Immediate cessation of operations for the NLRB is unlikely, though, due to the fact President Trump signed a bill last year that funds the agency through October 1, 2019. Accordingly, while the current budget dispute drags on, unfair labor practice charge, representation, and other proceedings before the board should remain unaffected. The NLRB is open for business, and it looks to be a busy 2019.
