Bob Calo’s dedication to being a resourceful lawyer is palpable. A skilled trial attorney and compliance lawyer, he offers clients a background drawing from more than 30 years of experience as an in-house compliance counsel, a federal prosecutor, and a white-collar criminal defense attorney. His knowledge of compliance risk management and white collar crime allows him to help clients confront the numerous legal or reputational threats they face every day.
Bob draws on his diverse experiences, taking a holistic approach when helping clients mitigate risk. He is often called upon to dive in and quickly assess allegations of misconduct – advising on the best course of action in response to the findings, which often includes negotiating with the government when a criminal prosecutor or regulatory official is involved or advocating for the client, business or other entity to face the least possible sanction, including numerous instances where he advocated to have charges dismissed or the government’s investigation shut down. For those clients, he then leverages his skills to craft remedial measures to help prevent future misconduct.
In private practice and as in-house counsel, Bob conducted scores of highly sensitive and complex internal investigations in every corner of the globe, including China, South America, Russia, India, and Africa. He has extensive experience navigating the myriad obstacles that can arise in conducting cross-border investigations, such as China’s state secrets prohibitions, EU privacy safeguards, and the blocking statutes of several individual countries in Europe. He is adept at performing cost-efficient and time-sensitive compliance investigations involving high-stakes matters related to bribery, accounting fraud, the False Claims Act, and more. He has also conducted investigations of sexual misconduct and other workplace violations involving high-level executives and making presentations to boards of directors, audit committees and outside auditors in connection.
Bob also has deep experience in proactively advising clients on policies, procedures, and best practices. In particular, he has a strong understanding of the legal and compliance risks that domestic and multinational companies confront in the areas of accounting fraud, bribery, trade sanctions, cybersecurity, privacy, and money laundering. Bob has counseled numerous high-level executives on how to effectively operate their businesses without running afoul of legal or compliance issues. He has also drafted policies and set up systems and protocols related to key compliance functions and has conducted employee training sessions on compliance issues. Further, Bob has been involved in numerous compliance due diligence audits related to mergers, acquisitions and divestures, joint venture operations, and vetting third party entities that help businesses go to market.
Bob served over 17 years as a criminal Assistant United States Attorney in Los Angeles and Philadelphia, including a stint as an SEC enforcement attorney. He tried over 40 criminal jury trials in federal court and conducted numerous evidentiary hearings before judges and regulatory bodies. His extensive trial and white collar litigation experience includes representing clients in federal and state courts across the country and before administrative bodies such as the Securities Exchange Commission (SEC) and the Environmental Protection Agency (EPA); representing clients testifying on Capitol Hill; and conducting hundreds of grand jury trials and other investigations.
Prior to joining Barnes & Thornburg, Bob was senior compliance counsel with Nokia, based out of London and the Silicon Valley. As in-house counsel, he headed up a global team of lawyers and investigators responsible for conducting all compliance investigations at the company.
Prior to going in-house, Bob was a partner at a well-known Pacific Northwest law firm where he established his private practice and laid down roots in the legal community.
Part of Bob’s goal is to ensure he helps keep his clients current with the ever-evolving corporate compliance standards promulgated by the DOJ and other international, state, and local government agencies. He shares this knowledge having written numerous articles and presented at numerous American Bar Association speaking engagements throughout his career.
