Antitrust Law Updates for Retailers

The Litigation Department and Antitrust Practice Group were sponsors of the recent Retail Industry Leaders Association (RILA) Conference Oct. 16-18, 2013 in Phoenix. Kendall Millard of the Indianapolis office and Valerie Mullican of the Grand Rapids office spoke at the conference, providing "Antitrust Law Updates for Retailers." They addressed the DOJ's recent enforcement actions and theories of liability challenging Most Favored Nation (MFN) clauses, including the recent verdict against Apple for its contracts with publishers for eBooks, and provided an update about the muddled area of Resale Price Maintenance (RPM) and Minimum Advertised Price (MAP) agreements.
