Patent Inference
OVERVIEW

Patent Interferences

In most countries, the first to file a patent application, not the first to invent, is awarded a patent. In the U.S. the first to invent and diligently to file a patent application or reduce the invention to practice is awarded a patent. In the U.S. conflicting claims by different applicants to the same invention are resolved in an Interference proceeding before the Board of Patent Appeals and Interferences.

Barnes & Thornburg has successfully represented clients in Interference proceedings before the Board of Patent Appeals and Interferences.
