Mitchell Berry is a management-side labor and employment litigator who represents employers in high-stakes labor relations matters and employment disputes in federal and state courts, before administrative agencies, and in arbitration. He guides businesses through complex, high-pressure situations with a practical, solutions-oriented approach grounded in rigorous preparation and efficient execution.

Mitchell’s practice centers on representing employers in labor disputes under collective bargaining agreements, including grievances and discipline/discharge matters, contract interpretation issues, and related arbitrations. He regularly serves as first- or second-chair in arbitrations arising under CBAs, managing the full lifecycle of the matter from case strategy and discovery through hearing and post-hearing briefing. Mitchell also defends employers in unfair labor practice proceedings before the National Labor Relations Board.

In addition to labor arbitration, Mitchell advocates for businesses in federal and state courts, administrative proceedings, and arbitrations. He is experienced in defending depositions of corporate representatives, board members, officers, and employees, as well as taking plaintiff and third-party depositions. He is adept at developing a record for dispositive motions and hearings.
