Intellectual property law counselor, Mark Hagedorn, is about defending innovation, creativity, and invention. He guides clients through the complex landscape of litigation involving patents, trademarks, and copyrights, helping businesses protect their intangible assets in the U.S. and abroad.

In the courtroom, Mark is a formidable advocate. He has successfully litigated claims at the United States Patent and Trademark Office in federal courts across the country. However, his true strength lies in finding creative solutions that resolve disputes early on, saving clients valuable time and resources. Whether through diplomacy, mediation, design changes, and/or strategic settlement, Mark is dedicated to consistently delivering optimized results that safeguard client investment.

By combining legal acumen with an engineer's problem-solving mindset, Mark crafts strategies that not only defend intellectual property portfolios and individual assets but also can drive business growth. His ability to distill complex technical concepts into clear legal arguments frequently gives clients a distinct edge in negotiations and courtroom battles alike. Mark advises innovative clients on securing and enforcing IP assets in emerging technology areas, including the emerging areas of quantum computing and AI, in order to maximize value through patents, trade secret protections, and licensing agreements.

Mark's experience spans a diverse range of technologies ranging from the above to specialty packaging and manufacturing equipment, as well as functionalized biocompatible polymers and cardiac marker immunoassays. This broad technical foundation allows him to quickly grasp the nuances of client development and tactical legal strategies that align with business objectives.

  • Cardiac Marker Immunoassay: Represented a large, multi-national medical diagnostic products company in regard to patent infringement claims concerning point-of-care immunoassay products. The case was resolved favorably prior to trial in light of strong patent invalidity defenses.
  • Multilayer Barrier Food Packaging: Defended a manufacturer of high-barrier, multilayer food packaging films in a patent infringement matter, including the successful defense of a preliminary injunction motion. The case settled favorably prior to trial.
  • Bulk-material Handling Dust Control Systems: Represented a designer and manufacturer of dust control systems for bulk material handling systems in the defense of patent infringement claims tried to a jury. Tried inequitable conduct in a subsequent bench trial. The three asserted patents were found invalid and/or not infringed, and all three were rendered unenforceable due to inequitable conduct.
  • Pressure Sensitive Adhesives. Defended a large, multi-national manufacturer of plastics products in a patent infringement matter regarding planetary roller extruder adhesive compounding. Obtained a jury verdict of no infringement and judgment as a matter of law of patent invalidity.
  • Mobile, Expandable Shelters: Represented a manufacturer of mobile expandable shelters in a 28 U.S.C. §1498 infringement claim against the United States. After obtaining favorable claim construction, the matter was favorably resolved by a seven-figure judgment against the United States.
  • Differential Pressure Gages: Prosecuted claims of trademark, trade dress and copyright infringement on behalf of national manufacturer of measurement devices and obtained a jury verdict of infringement.
  • Automotive Interiors: Represented an OEM manufacturer in a patent infringement action brought against a competitor relating to the manufacture of automotive interior panel skins.
  • Hair Clippers: Defended a globally-known manufacturer of hair cutting products against patent infringement and trade secret misappropriation claims. Obtained a judgment of no infringement, patent invalidity and patent unenforceability due to inequitable conduct and an award of attorney fees.
