Partner Arthur Armstrong was featured in a Law360 interview discussing a growing area of conflict in cyberinsurance, coverage sublimits tied to ransomware claims. Armstrong, who represents policyholders, explains how insurers sometimes attach low-dollar endorsements to policies that otherwise carry much higher limits, creating confusion and disputes when a ransomware claim comes in far above the sublimit. 

He discusss a February ruling where a Texas federal court declined to enforce a $250,000 ransomware sublimit against a $3 million policy because the endorsement didn't clearly modify the underlying coverage grant. Armstrong notes that courts generally construe ambiguous policy language in favor of policyholders, and outlined how companies can strengthen their position by promptly satisfying notice and proof-of-claim requirements and pressing insurers for a timely coverage determination.
