The session will explore how post-filing data can support inventive step at the European Patent Office (EPO) and non-obviousness in the U.S., drawing on key EPO Board of Appeal decisions and emerging guidance from the Unified Patent Court, United States Patent & Trademark Office (USPTO), and U.S. courts. Attendees will gain practical strategies for drafting life sciences and biotech patents to improve grant success and strengthen applications for examination.
