A proven litigator and trusted adviser, Jackie Papish concentrates her practice on matters involving healthcare fraud and abuse and white collar defense. Notably, Jackie has significant experience working on a range of high-stakes, complex civil and commercial litigation matters and government and internal investigations.

Jackie regularly represents clients in False Claims Act (FCA) litigation and related civil and criminal investigations by the U.S. Department of Justice (DOJ), Department of Health and Human Services Office of Inspector General (HHS-OIG), Food and Drug Administration (FDA), Drug Enforcement Administration (DEA), and other federal and state regulators.  Her work is concentrated on the healthcare and life sciences industries but has spanned a number of others, including technology and financial services.

Jackie’s strength is in helping her clients feel at ease in the face of high-stress situations. She possesses a keen ability to make even the most challenging matters clear and manageable. Her focus is on gathering the facts and ensuring each client’s story is understandable and compelling while remaining committed to providing the best results and a value-oriented approach to her representations.

Jackie is dedicated to donating her time to pro bono matters and has continuously achieved successful results for such clients, including a fully favorable decision for a client seeking Social Security benefits and improved educational services for a developmentally delayed child.

Prior to joining the firm, Jackie practiced at leading international and national law firms representing both plaintiffs and defendants in virtually all stages of litigation, from early dispute resolution through appeal. She also clerked for the Hon. William S. Duffey, Jr. (Ret.) of the U.S. District Court for the Northern District of Georgia and assisted Judge Duffey when he sat by designation on the U.S. Court of Appeals for the Eleventh Circuit.

Prior Experience

  • Obtained dismissal of qui tam matter alleging Fortune 50 pharmaceutical company caused the submission of false claims through the sale and marketing of its pharmaceutical product based on insufficient labeling that failed to adequately warn practitioners about certain known side effects
  • Negotiated favorable settlement with the DOJ and HHS-OIG for provider in qui tam action alleging false claims submissions resulting from unnecessary medical procedures
  • Counseled Fortune 50 health insurance company on FCA concerns relating to risk adjustment practices under its Medicare Advantage plans
  • Counseled biopharmaceutical company in pre-acquisition due diligence relating to concerns about False Claims Act, Anti-Kickback Statute, FDCA, and related regulations
  • Counseled healthcare provider regarding NPI fraud related to durable medical equipment prescriptions and subsequent report to HHS-OIG and CMS
  • Obtained dismissal of final remaining criminal charge in decade-long white collar criminal fraud matter
  • Represented a healthcare technology startup against a pharmacy benefits manager in contract, statutory, and tort claims valued at over $600 million
