Garrett Llewellyn is a first-chair trial lawyer representing clients across numerous industries in complex commercial litigation and class action defense, including disputes associated with breach of contract, unfair competition and similar business torts, breach of fiduciary duty, violation of the TCPA and other consumer protection statutes, and consumer fraud.

As co-chair of Barnes & Thornburg’s Consumer Class Action Defense Practice Group and a member of the firm’s Complex Commercial Litigation Practice Group, Garrett handles high-profile business disputes for large public and private companies across the country. Indeed, Garrett’s clients cover a wide range of sectors including retail, hospitality, sports and entertainment, healthcare, financial services, real estate, automotive, and technology and telecommunications.

Garrett is valued for his aggressive and innovative litigation strategies designed to achieve his clients’ goals and efficiently resolve their disputes. Whether in writing or at oral argument, Garrett persistently advances his clients’ position to protect their rights and accomplish their over-all litigation objectives. 

Prior to joining Barnes & Thornburg, Garrett served as counsel in the Los Angeles office of Akin Gump Strauss Hauer & Feld LLP.

Trial Experience

  • Lead trial counsel in a nine-figure dispute between a publicly traded international corporation and a former contracting partner involving claims for breach of contract, fraudulent inducement, and intentional interference with contract
  • Prevailed as first-chair trial counsel in a six-figure commercial dispute against a commercial real estate holding company and lessor
  • Prevailed at trial and awarded costs on behalf of a hotel owner in a declaratory relief action brought by a plaintiff who wrongfully contended that applicable law required the maintenance of a road that runs adjacent to the hotel in connection with any redevelopment
  • Prevailed at trial on behalf of defendants and counterclaimants and recovered a multimillion-dollar judgment and attorneys’ fees award on behalf of a group of entrepreneurs who were defrauded by the plaintiff
  • Prevailed before a three-judge arbitration panel on behalf of a limited liability company in a multimillion-dollar breach of fiduciary duty and fraud dispute filed by a former member
  • Prevailed at trial and recovered substantial attorneys' fees and costs on behalf of an international hedge fund in a $500 million breach of contract and defamation dispute

Class Action Experience

  • Defeated FRCP Rule 23(f) petition seeking appeal of trial court’s denial of class certification in putative nationwide consumer class action
  • Defeated class certification on behalf of an international automobile manufacturer in a nationwide vehicle defect class action filed by 43 plaintiffs from 23 states
  • Successfully defeated a putative nationwide class action filed against a Fortune 100 company alleging violations of California consumer protection laws 
  • Obtained summary judgment and defeated class certification on behalf of a national veterinary hospital chain in a $40 million nationwide consumer fraud class action arising out of labeling and sales
  • Favorably resolved two putative nationwide class actions filed against a nationwide retailer of audio equipment alleging violations of California consumer protection laws
  • Favorably resolved a class action alleging violations of California law filed on behalf of more than 20 million putative class members against a data research company
  • Resolved a putative Telephone Consumer Protection Act class action on behalf of a home furnishings retailer after persuading plaintiff's counsel to voluntarily dismiss the case with prejudice
  • Resolved a putative Telephone Consumer Protection Act class action on behalf of a national clothing retailer after persuading plaintiff's counsel to drop the case

Additional Commercial Litigation Experience

  • Represented a world renowned consumer products company in a breach of contract and other business torts case asserting claims against the company’s former partner and manager with regard to corporate mismanagement and misappropriation
  • Successfully dismissed an arbitration filed by a television producer against former on-air talent alleging breach of contract and fraud in connection with production of the series
  • Obtained summary judgment on behalf of a professional athlete in a defamation action filed by two individuals seeking more than $100 million in damages
  • Obtained summary judgment and an award of attorneys’ fees on behalf of an international toy manufacturer in a breach of contract action filed by a former vendor
  • Successfully argued before the California Court of Appeal and persuaded the Court to uphold the trial court’s dismissal of breach of fiduciary duty and breach of contract claims against a legal services provider
  • Represented numerous entertainment industry clients including numerous National Basketball Association players, actors, producers, directors, and television personalities in tort and contract disputes collectively totaling more than 100 million
  • Represented a luxury hotel owner in a nine-year dispute against a well-known luxury hotel management company in a $300 million breach of contract and tort case involving a hotel management agreement
  • Represented a high-value asset management company in a $100 million dispute surrounding the collection and payment of dividends
  • Represented several corporations and related entities against a $500 million False Claims Act case advanced by the United States
  • Represented a National Football League team with respect to several insurance disputes surrounding coverage for multiple tort claims in excess of $30 million
