David C. Hill is a member of the Real Estate Department in Barnes & Thornburg's Grand Rapids and Detroit Metro offices.

David represents local and national real estate owners and developers related to acquisition, leasing, sale, financing, development and construction matters. His experience also extends to representation of private investors and lending institutions to structure loans for projects including construction, bridge and participating loans and loans secured by leases.

David has acted as counsel in hundreds of such real estate and lending matters and has substantial experience, particularly in the negotiation and closing of sale and lease transactions for office, retail, multifamily, and medical clients.

He is also a pro bono attorney with Legal Aid of Western Michigan.

David is a LEED Accredited Professional.

Experience

David Hill has represented creditors, and other institutions in a wide range of insolvency matters, including workouts, reorganizations, and receivership matters. In the receivership context, he has provided counsel within wide-expanse of different industries on issues impacting the appointment of receivers, day-to-day receivership operations, and the restructuring and/or liquidation of operating companies and related real estate. Many of the matters have involved significant inter-creditor disputes and contests within appellate courts.

Representative Cases

  • Represented creditor in $50+ million dollar multi-year receivership and liquidation in tax fraud matter.
  • Successfully defended contested receivership over automotive parts and affiliated real estate companies, including favorable resolution of priority disputes among the creditors.
  • Represented bank in over 75 loan restructuring, receivership and related transactions, including restaurants, gas stations, retail, office, industrial and multifamily real estate operators, manufacturers, hotels, law firms, medical practitioners, and other service providers.
  • Represented national financial institution following acquisition from the FDIC of failed banking assets in dozens of receivership matters and counseled on related FDIC loss-share considerations.
  • Oversaw operations and sale of multiple golf courses and related operating companies through receivership actions.
  • Represented bank in significant and complex disputed receivership litigation matter, including successful defense of a multi-party appeal to the Michigan Court of Appeals.
  • Obtained ex-parte appointment of receivership over multi-million dollar non-profit institution and defended contested receivership matter following board fraud allegations.
