David Kelly

David is a full-service attorney with 20 years’ experience counseling clients, prosecuting and litigating IP matters, drafting and enforcing agreements, and providing clearance and IP due diligence opinions. David vigorously defends his clients’ IP rights, representing them in district and appellate courts, and before administrative panels, in matters involving patents, trademarks, trade secrets, false advertising, unfair competition, contracts, and anti-trust.

David counsels clients in a wide variety of technologies, including life sciences, reproductive technologies, immunology, pharmaceutics, plastics, medical devices, financial services, and compliance. 

David serves as lead trial counsel for clients in federal district courts throughout the United States, as well as in contested cases before the U.S. Patent & Trademark Office. He is also an experienced appellate advocate, arguing multiple cases before the Federal Circuit and the Patent and Trial Board.

Additionally, David manages his clients’ international IP portfolios, overseeing the prosecution, licensing, and enforcement of hundreds of patents and trademarks. He routinely provides clearance opinions and conducts of IP due diligence reviews.

David is also dedicated to pro bono work. He has drafted terms of use and privacy policies for dozens of Atlanta-based non-profits and, in 2021, he helped secure an inmate’s compassionate release from prison after serving nearly 30 years in prison.

A noted thought leader, David has authored dozens of articles, provided commentary in leading business publications, and given numerous presentations on legal writing and IP issues.

David is also an avid hiker and backpacker, and has hiked various sections of the Appalachian, Bartram, and Benton McKaye trails.
