50-State Survey: Coverage for Construction Defect Claims and the Occurrence Issue

Clifford Shapiro of the Chicago office attended and spoke at the annual meeting of the American College of Construction Lawyers (ACCL) held Feb. 19-22 in Miami. Clif is the chair of the ACCL's Insurance Committee and his presentation was part of a panel discussion that included an update to Clif's 50-state survey regarding coverage for construction defect claims and the occurrence issue, an in-depth discussion of emerging case law regarding the commercial general liability policy's contractual liability exclusion in the construction defect coverage context, and current issues regarding additional insured coverage.
