The Biden administration’s robust policy agenda has seen federal agencies like the Department of Labor (DOL), National Labor Relations Board (NLRB), and Federal Trade Commission (FTC) announce and implement sweeping and aggressive new rules and regulations. However, when challenged in court, the agencies have not fared well. For employers, the result is a confusing state of what was, is, and will (again) be the law.
