Now that the Federal Trade Commission’s attempted broadside at non-competes is on hold, we turn back to the groundswell of state laws addressing non-competes.

Some are directed at non-competes generally and some specifically directed at the healthcare industry. Physician non-competes have always received extra scrutiny to avoid restricting the availability of medical services. Add to that more and more state laws, and it is hard to know what to expect in drafting, negotiation, and enforcement settings.
