Attorney Presentation - "Environmental and Toxic Tort Liabilities: Challenges and Solutions"

David Gillay, Joe Eaton and John Fischer of the Indianapolis office presented a 1.5-hour CLE program entitled "Environmental and Toxic Tort Liabilities: Challenges and Solutions" on Feb. 7 live in the Indianapolis office and by videoconference in the Fort Wayne and South Bend offices. The program was co-sponsored by the firm and the Indiana Manufacturers Association. Dave addressed various issues of concern relating to environmental liability, including vapor intrusion, trichloroethylene (TCE) contamination, and Indiana's risk-based statute and guidance. Joe spoke about liability theories, causation, admissibility of expert testimony and damages in toxic tort litigation. John addressed the scope of coverage for environmental and toxic tort claims under general liability policies in Indiana and the steps policyholders should take to preserve coverage for those claims.
