Russell T. Gorkin is counsel in the Litigation Department. He focuses on helping clients successfully resolve their most complex and high-stakes disputes, including contract disputes and related business torts, and bankruptcy-related matters.

Russell T. Gorkin is counsel in the Litigation Department. He focuses on helping clients successfully resolve their most complex and high-stakes disputes, including contract disputes and related business torts, and bankruptcy-related matters.

Russell regularly appears before federal and state trial and appellate courts and arbitral tribunals, and is highly regarded for his legal reasoning and ability to persuade through both written and oral advocacy.

Russell has experience leading virtually all phases of litigation, including pre-suit investigations and correspondence, negotiating discovery disputes and arguing discovery motions, deposing witnesses, managing expert discovery, preparing and arguing dispositive motions, preparing fact and expert witnesses to testify, examining and cross-examining fact and expert witnesses, briefing and arguing appeals, and participating in mediation and settlement discussions. 

Russell’s scholarship has appeared in the Harvard Journal of Sports & Entertainment Law and the Duke Journal of Constitutional Law and Public Policy Sidebar, and has been cited in the Harvard Law Review and in an amicus curiae brief filed with the Supreme Court of the United States, among other places.

Prior to joining the firm, Russell was a senior associate at an AmLaw 50 firm. Before law school, Russell worked for several years as a management consultant.

Experience
  • Secured an eight-figure settlement on behalf of an alternative investment firm alleging breach of contract and other claims against a multinational pharmaceutical company based upon its premature termination of phase 3 clinical trials following a two-week arbitral merits hearing featuring 20 witnesses.*
  • Proved successfully on behalf of the purchaser of a Paraguayan bank that a major financial institution breached several of its contractual representations and warranties in a transaction valued at more than $250 million.*
  • Obtained a complete dismissal of all claims, including conversion and fraud, asserted against a major entertainment and media company by the composer of some of its best-known theme songs.*
  • Obtained complete dismissal of all claims asserted against a number of major financial institutions arising out of the 2007 leveraged buyout of a national media conglomerate*
  • Represented one of the largest asset managers in Asia in ongoing fraudulent transfer litigation arising from the Madoff Ponzi scheme.*
