Commercial litigator and product liability defense attorney Oni Harton guides clients through complex dispute mitigation, resolution and litigation from the preliminary counseling stage through appeal. She focuses on providing legal counsel that is creative, resourceful and sensible when designing strategies that are as distinct as the clients she serves.
Oni is dedicated to effectively navigating clients through virtually every stage of the litigation process, from pleadings through appeal and in providing pre-litigation advice and risk assessments. Oni’s practice includes product liability defense involving prescription medical devices and toxic torts. Oni has defended numerous clients in product liability matters involving consumer products allegedly causing death, injury and property damages. She has litigated cases in more than 20 states.
Many of Oni’s cases require working with experts in areas such as accident reconstruction, metallurgy, chemical reactions, toxicology, epidemiology, chemical exposure medial causation, biomechanical injury analysis and economic loss. At the outset of each matter, she works with clients to develop case-specific strategies for fact investigation, written discovery, document production, depositions, motion practice, retaining experts, and excluding or limiting unreliable expert testimony proffered by opponents. Oni’s arguments have been presented on appeal in product liability matters.
Oni also advises on high-stakes commercial litigation. This experience includes UCC disputes, service disputes, and business torts such as unfair competition, misappropriation of trade secrets, noncompete/nonsolicitation enforcement and business separations, as well as premises liability claims.
Oni is valued by those she serves for her commitment to achieving specific client goals and developing strategies that focus on that decided objective. Calm, cool and collected, Oni does not believe in wasting client time and resources by fighting unnecessarily. She seeks to minimize and avoid the emotional drivers inherent in most disputes in order to realize her clients’ vision of success.
While Oni has helped clients through seeking resolution via dispositive motions and trial, she seeks out-of-court solutions where possible. To this end, she has experience in dozens of mediations and informal settlement negotiations. In addition to her litigation practice, Oni’s thoughtful, no-nonsense style and broad risk management experience frequently lead to her involvement as part of the client’s strategic team. In this role, Oni works with clients to develop and implement mitigation and litigation avoidance strategies.
While in law school, she was a legal extern, Indiana Board of Tax Review, and a judicial extern for the Honorable Patricia A. Riley of the Indiana Court of Appeals. Prior to the law, Oni worked as a content specialist for an information management company providing technical solutions to the U.S. General Services Administration.
