His recent experience includes the following matters:
- Currently representing the former CEO of an electric car manufacturer in parallel shareholder derivative and securities class action lawsuits.
- Defended a national pharmacy company against qui tam claims under the False Claims Act. Obtained a complete dismissal of all claims with prejudice and an affirmance on appeal.
- Defended the independent directors of an international manufacturing company against putative class action claims for violations of federal securities laws and shareholder derivative claims for breach of fiduciary duty and aiding and abetting breaches of fiduciary duty. Obtained a complete dismissal of all claims prior to discovery.
- Represented a financial services company in claims of breach of contract, tortious interference with contract and unfair competition arising from a competitor’s raid of the client’s sales and distribution team. After Mr. Matteo commenced litigation in two courts and filed a motion for a preliminary injunction, the case settled on favorable terms.
- Represented a technology company in breach of contract claims under a software licensing agreement. Obtained summary judgment for the full amount of damages sought.
- Represented an international trade finance fund in connection with claims for breach of a credit agreement and note. Obtained summary judgment for the full amount of damages sought, plus attorneys’ fees and costs.
- Represented an international entertainment company in claims for breach of a music licensing agreement. After defeating the defendant’s motion to dismiss, the case settled on favorable terms.
- Defended an international manufacturer of home appliances in an arbitration concerning an alleged breach of a trademark licensing agreement. The arbitration panel denied the claimant’s claims in full and awarded the claimant no damages.*
- Defended a beverage producer against breach of contract claims asserted by a former distribution partner. After a two-week arbitration, the panel awarded the claimant a fraction of the damages sought.*
- Represented the court-appointed liquidators of a hedge fund in multiple litigation arising from the fraudulent transfer of the fund’s assets. Obtained multiple judgments against recipients of the fraudulent transfers, which the appellate court affirmed on appeal.*
- Obtained complete dismissal of breach of contract and tort claims asserted against a boutique investment bank arising out of a bond refinancing and interest-rate swap contract.*
- Served as trial counsel to a broker-dealer in two arbitration proceedings. At the conclusion of each arbitration, the panel found in favor of the broker-dealer in all respects.*
