Mike McCrory’s practice included business, commercial, bankruptcy and creditors’ rights matters. He advised on complex workouts and loan restructurings, the representation of secured and unsecured creditors and creditors’ committees in bankruptcy cases, commercial and bankruptcy mediation, real estate foreclosures, repossessions, and general collections, as well as Uniform Commercial Code issues.

Mike McCrory’s practice included business, commercial, bankruptcy and creditors’ rights matters. He advised on complex workouts and loan restructurings, the representation of secured and unsecured creditors and creditors’ committees in bankruptcy cases, commercial and bankruptcy mediation, real estate foreclosures, repossessions, and general collections, as well as Uniform Commercial Code issues.

Mike is certified by the American Board of Certification as a Business Bankruptcy Specialist. In addition, he successfully completed the American Bankruptcy Institute/St. John's University School of Law Bankruptcy Mediation Training Course and is a registered civil mediator in Indiana.

Mike offered industry experience in the automotive and aerospace sectors. He regularly worked with manufacturers and automotive suppliers to address a broad range of matters, including contract negotiation and enforcement, collections and bankruptcy issues. He also has deep experience in the area of higher education, and advised clients on multiple issues relating to student loan dischargeability and student loan documentation, compliance, accreditation and re-accreditation matters.

Valued for meeting and transcending client expectations, deadlines and budgetary requirements over decades of practice, Mike’s commitment to solving his clients’ problems was supported by his ability to strategize on matters large and small. His broad experience in bankruptcy law and practice allowed him to navigate even the most difficult terrain and changing economic conditions. On many occasions, clients turned to Mike to explore their options regarding potential reorganizations and restructurings, financings, supply chain challenges and other similar initiatives.

Mike thrived under the fast-paced, pressurized demands of the insolvency practice. Notably, Mike recently worked with a major OEM on a critical matter involving just-in-time delivery and sole source supplier issues, where he ably guided the client through time sensitive supplier challenges.

Exceedingly professional, Mike was appreciated for his ability to deal with difficult scenarios quickly by providing solutions that realized his client’s goals. Mike was all about the end game when dealing with formidable obstacles and serious problems, and worked diligently to achieve desired outcomes in the face of divergent perspectives and unreasonable demands or ultimatums.

Mike acted as the firm’s Indianapolis administrator of the Finance, Insolvency and Restructuring Department, and co-chaired the Global Services practice and the firm’s Automotive Industry team. Mike previously served as an active member of the firm’s management, recruiting and client relations committees.

EXPERIENCE

  • Assisted client in negotiating, documenting and securing approval of purchase of significant limestone reserves and other assets from Bankruptcy Estate. In re Smith Mining Materials, Inc., No. 06-30259 (Bankr. W.D. Ky. 2006).
  • Coordinated and filed involuntary bankruptcy case on behalf of utility client and asserted claims within bankruptcy case on client’s behalf.
  • Representation of automotive suppliers, aircraft lessor, health insurance provider, and governmental authorities with tax claims in Chapter 11 case of tier one automotive supplier.
  • Representation of party to pre-petition business purchase and sale transaction, as holder of unpaid note, indemnity and other claims against Chapter 11 debtor involved in Section 363 sale.
  • Represented automotive supplier to key Detroit automakers in business restructuring and refinance transaction involving negotiation of agreements and accommodations with multiple constituencies, and documentation of refinancing transaction, business restructuring transactions and agreements with customers and suppliers in order to accomplish out of court resolution of multiple business and financial issues.
  • Represented financer of over 1500 leases between debtor and its customers in connection with assertion of claims against the debtor and financer, and with resolution of class action lawsuits lodged by customers of debtor throughout the U.S.
  • Represented key supplier and creditors’ committee member in connection with sizeable claims and obligations. Negotiated resolution of preferential transfer claims asserted against client.
  • Represented major secured creditor holding liens on trucks and equipment in connection with litigated adequate protection and valuation issues, and in connection with objections to proposed treatment of client’s multi-million dollar claim under plan of reorganization.
