Brad Love is an experienced trial lawyer and co-chair of the firm’s Antitrust and Competition Law practice. He represents clients in criminal investigations, merger reviews, high-stakes litigation, and civil enforcement actions and is a quick study identifying solutions in complex cases and internal investigations or designing effective compliance programs and policies.

OVERVIEW

Brad Love is an experienced trial lawyer and co-chair of the firm’s Antitrust and Competition Law practice. He represents clients in criminal investigations, merger reviews, high-stakes litigation, and civil enforcement actions and is a quick study identifying solutions in complex cases and internal investigations or designing effective compliance programs and policies.

Brad represents national and international businesses in intellectual property litigation, commercial litigation, criminal cases, and regulatory proceedings, and he advises clients in government investigations, agency proffers, Hart-Scott-Rodino (HSR) filings, and witness interviews. He has experience in civil and criminal jury trials, International Trade Commission hearings, Federal Trade Commission proceedings, mediation, and arbitration.

Brad has managed complex litigation, class actions, and appeals in various state and federal courts, including several high-profile nationwide multidistrict litigation (MDL) proceedings. He counsels corporations and individuals accused of price fixing, bid-rigging, customer allocation, or other crimes by the Antitrust Division of the Department of Justice. He also provides compliance training and advises clients developing antitrust, anti-bribery, and export control compliance programs.

Brad strives to serve as a strategic counselor who partners with clients to develop strategies that support and enhance their ability to compete throughout the investigation, litigation, or merger review process. He offers experience in a variety of technical disciplines, as well as in industrial organization and economics.

Antitrust

  • Represented automobile parts manufacturers, Tokai Kogyo Ltd. and Green Tokai Co., Ltd., in month-long criminal antitrust trial, obtaining not guilty verdicts for both clients on DOJ charges of price fixing, bid rigging and market allocation
  • Represented an international electronic components manufacturer in a government investigation and nationwide MDL litigation by proposed classes of direct and indirect purchasers and negotiated early settlements with class plaintiffs 
  • Defended a national foam manufacturer against price-fixing claims brought by classes of direct and indirect purchasers and an assortment of individual plaintiffs including furniture and bedding manufacturers, in a nationwide MDL, and obtained settlements for the client in all of the cases shortly before trial
  • Obtained a dismissal of all class-action claims brought against a major credit card issuer and defeated the proposed class of merchants’ preliminary injunction motion in a nationwide antitrust and unfair competition class action arising from the shift to EMV chip technology
  • Represented an international automotive parts manufacturer in a government investigation and nationwide MDL litigation by proposed classes of direct and indirect purchasers and negotiated early settlements with class plaintiffs
  • Defended a Pacific Rim airline against class-action claims of worldwide price-fixing in an MDL, settling all claims shortly before trial
  • Counseled an international chemical company on a cross-border merger review, merger clearance and competition challenges in a potential merger with a competitor
  • Obtained antitrust clearance from the Federal Trade Commission for the acquisition of a nationwide chain of assisted-living facilities by a real estate conglomerate

Intellectual Property

  • Secured a final determination by the International Trade Commission that optical fiber manufacturer, OFS Fitel, LLC, did not infringe patents related to optical fiber properties and coating compositions and that all asserted patent claims were invalid in a §337 investigation
  • Represented an individual inventor and metallurgist in a two-week jury trial and related litigation alleging trade secret misappropriation, obtaining a verdict of no misappropriation and a dismissal
  • Obtained a complete dismissal for Google Inc. on right of privacy and defamation claims related to YouTube, Google Maps and Blogger
  • Represented a multinational technology and materials company in federal patent infringement and trade secret litigation 
  • Defended a leading manufacturer of fiberglass insulation in a PTAB inter partes review proceedings, convincing the PTAB not to institute post grant review on many patent claims and to deny a competitor’s challenges to the manufacturer’s patents on the instituted grounds
  • Obtained summary judgment for Google Inc. on Perfect 10, Inc.’s on copyright, trademark and right of publicity claims based on Communications Decency Act (CDA) immunity and Digital Millennium Copyright Act (DMCA) safe harbors, and prevailed on the plaintiff’s Ninth Circuit appeal
  • Represented a multinational technology company and hardware manufacturer in patent infringement litigation brought by a non-practicing entity and related PTAB inter partes review proceedings invalidating asserted patent claims
  • Counseled a Japanese technology company regarding antitrust challenges to a defensive patent cross licensing agreement
  • Represented high tech/telecomm companies in an International Trade Commission §337 patent investigation of smartphones brought by a major tech company
