Kevin Collins represents creditors and other interested parties in Chapter 11 bankruptcy cases and related adversary proceedings in Delaware and various other jurisdictions throughout the United States. Kevin is dedicated to serving as a strategic legal adviser, an organized, efficient and responsive service provider, and an active listener who seeks to understand each client’s needs.

Kevin’s clients have included trade creditors, lien claimants, asset purchasers, landlords, utilities, lenders, trustees, preference and fraudulent transfer defendants, and other interested parties in bankruptcy reorganization and liquidation proceedings. He has participated in many large and complex commercial restructurings across a broad array of industries, including retail, healthcare, manufacturing and energy, both in Delaware and across the country.

Kevin also renders opinions on enforceability, substantive non-consolidation, true sale and other creditors' rights matters.

Kevin understands, from years of hands-on experience, that every debtor is unique. As a result, he is often called upon to resolve issues ranging from landlord/tenant matters and tax problems to contractual and employment issues, among many others. Regardless of the challenge or complexity of the matter at hand, Kevin makes a point of understanding what his client wants to achieve, as well as the details and overarching goals of the case at hand. Kevin strives to work collaboratively with Delaware attorneys and with opposing counsel to obtain a desirable and cost-effective resolution of his client’s legal concerns.

While in law school, Kevin served as a legal extern for the Honorable Judge Kent A. Jordan of the U.S. Court of Appeals for the Third Circuit.

EXPERIENCE
  • Represented a San Francisco, California-based rideshare company in their 363 sale acquisition of a company that created a marketplace specifically designed for rideshare drivers. The company, based in Los Angeles, was a national car-sharing marketplace that includes ridesharing, food and packaging delivery.
  • Represented multiple consignment vendors in a Delaware Chapter 11 case concerning complex issues related to ownership and perfection of rights in consigned goods and challenges raised by a secured lender group relating to the allocation of sale proceeds
  • Represented numerous landlords and receivers with respect to issues concerning administrative claims, assumption or rejection of contracts and leases, assignment in the context of Section 363 sales and related issues in Chapter 11 cases in Delaware
  • Represented an unsecured seller of products, lessor of equipment and post-petition administrative claimant in various Chapter 11 cases or insolvency proceedings of hospitals, diagnostic laboratories and other healthcare organizations throughout the United States
  • Represented the largest secured creditor in its successful bid for dismissal of a Chapter 11 debtor’s case
  • Represented a financial advisory firm in defense against objections to, and in seeking allowance and payment on, its professional fees for services as an investment banker in a Delaware Chapter 11 case
  • Represented, as special litigation counsel, a Chapter 11 trustee in a Ponzi scheme case for the purpose of advising, litigating, pursuing and defending claims of the trustee in related proceedings in Minnesota
  • Represented a special servicer in non-judicial foreclosure proceedings concerning a $38 million mortgage loan and successfully defended against legal challenges to the client’s chain of title in proceedings in Maine
  • Represented a quasi-utility and electricity provider in multiple Chapter 11 cases in Delaware
  • Represented a gas and electricity provider in a $5.5 million preference action and obtained complete dismissal of the adversary proceeding without any settlement payment
  • Lead or local counsel for numerous defendants in preference, fraudulent transfer and other avoidance actions in Delaware
