Daniel Lawler advises and represents hospitals and other healthcare providers before regulatory agencies and in related litigation, including matters involving the Illinois Certificate of Need (CON) process. He also has significant experience with dispute resolution and business litigation on the provider side in matters involving managed care contracts.

Daniel Lawler advises and represents hospitals and other healthcare providers before regulatory agencies and in related litigation, including matters involving the Illinois Certificate of Need (CON) process. He also has significant experience with dispute resolution and business litigation on the provider side in matters involving managed care contracts.

With over 25 years of experience before the Illinois CON Board, Dan has frequently been engaged to represent clients in connection with high-profile and hotly contested projects. Recently, he represented a health system in obtaining a CON for a new acute care general hospital that will be only the second new, non-replacement hospital in the Chicago area in the last 30 years. Dan was also CON counsel on the previously approved new hospital project.

In addition, Dan served as CON counsel for the first Proton Therapy treatment center in Illinois. Moreover, he has represented national healthcare corporations in connection with large scale acquisitions of healthcare facilities that require change of ownership approval from the CON Board.

Dan has represented hospitals in numerous multimillion dollar disputes involving non-payment, under-payment and slow payment by insurers under their managed care contracts. He has also represented hospitals in reimbursement claims against insurers following the insolvency of several IPAs. On behalf of five hospital clients, Dan received the largest monetary judgment to date against the Illinois HMO Guaranty Association following the insolvency of an HMO.

In his representation of providers and other regulated entities, Dan has advised on licensing and compliance proceedings before the Illinois Department of Public Health, in Medicaid audit and recoupment actions by the Department of Healthcare and Family Services, and in compliance actions under the Illinois Health Facilities Planning Act.

Dan is the author of the chapter on “Establishment, Modernization, Acquisition and Discontinuation of Hospitals and Healthcare Facilities” in the Health Law volume of Illinois Jurisprudence.
