A member of the Corporate Department and Energy Transition Group, Nick Salalayko helps developers, lenders, and utilities bring energy and other infrastructure projects from concept to commercial operation navigating the complex energy landscape. With deep experience on both utility and developer sides, Nick provides a practical, business-minded approach to regulatory and transactional hurdles in the energy sector.

Nick advises clients throughout all stages of project development, from state siting proceedings to project financing, asset acquisitions and dispositions, and commercial operation. He assists through the full suite of project agreements, including power purchase agreements, interconnection agreements, and financing documents. Nick also has experience in a variety of regulatory proceedings at both the state and federal levels, including state utility commissions, Federal Energy Regulatory Commission, and the Department of Energy.

Nick regularly counsels clients on the competitive wholesale energy market rules in the regional energy markets, compliance with state and federal energy regulations, federal tax credit qualification, and clean energy incentive programs. For lenders and investors, he conducts due diligence on energy asset acquisitions and portfolio transactions, evaluating regulatory compliance, incentive program eligibility, and offtake arrangements.

Before joining Barnes & Thornburg, Nick advised independent power producers, utilities, and municipal light plants on the financing, permitting, and construction of electric generating facilities, experience that informs his practical approach to successfully overcoming complex challenges.

When he’s not at the office, Nick can be found hiking or skiing with his family and friends in the backcountry. He welcomes inquiries from developers, investors, and utilities navigating the complexities of energy and infrastructure projects.
