IP Litigation. Michael’s litigation practice involves patent, trademark and copyright disputes across the country. A former software developer, he has challenged and defended numerous software patents under Section 101. Drawing on decades of patent prosecution experience, he is able to identify issues in claim language and file histories that can shape the outcome of a case.

Patent Prosecution. Michael has drafted and prosecuted hundreds of patent applications involving a variety of technologies, including:

• Software and Computer Technology: Artificial intelligence, including generative AI, RAG systems, chatbots and computer vision; fintech; cryptography and secure transactions; cloud-based payment processing; blockchain technologies; data center networking; cybersecurity and antivirus technologies; and electronic medical record systems.
• Automotive: Electric vehicles; EV charging systems; autonomous vehicle technologies; infotainment systems; vehicle upfitting; wheelchair accessibility systems; and hitch assemblies.
• Commercial and Consumer Products: Electronic beverage dispensers; wearable technologies; sporting goods; audio systems; lighting systems; and automated musical instruments.
• Industrial: Pumping systems; refrigeration systems; surge suppression systems; equipment monitoring systems; pipe inspection technologies; and wire manufacturing.
• Building and Construction: Home automation systems; electronic locks; lock rekeying systems; padlocks; electronic faucets; and hand tools.

Licensing, Opinions and Technology Transactions. Michael negotiates IP licenses, software agreements and other technology-related agreements. He also prepares invalidity and freedom-to-operate opinions. He is a certified Black Duck Legal Professional and advises clients on open-source risk management, contract provisions involving open-source software, and open-source due diligence in M&A transactions.

Trademarks and Copyrights. His trademark practice includes selection and clearance, domestic and international prosecution, portfolio management, licensing and enforcement. He also advises clients on copyright protection, licensing and enforcement.
