Mike represents healthcare entities in fraud investigations involving the U.S. Department of Justice, U.S. Department of Health and Human Services-Office of Inspector General, and other federal and state agencies. Mike also has experience in conducting internal investigations for entities regarding a range of civil and criminal issues, and assessing potential legal exposure. In addition, Mike provides practical advice to healthcare entities on compliance with the federal Anti-Kickback Statute and its state analogues, as well as the Stark Law, the Civil Monetary Penalties Law, the False Claims Act, and other regulatory matters.

His practice includes reimbursement compliance, defense, and litigation, comprising Medicare and Medicaid audits, and private payor audits. He assists in responding to government audits related to reimbursement and coverage criteria and has handled the various stages of the administrative appeals process for the Medicare Program, including appeals of final agency determinations at the federal district court-level.

Prior to joining Barnes & Thornburg, Mike practiced in the Healthcare & FDA group of a global law firm. Earlier in his career, he regularly advised clients on privacy and cybersecurity issues. This included assisting healthcare and non-healthcare companies in responding to data breaches and data security incidents by coordinating forensic investigations, leading notification reviews, and advising on notification compliance. He also provided more proactive assistance to companies in preparing for data security incidents by developing incident response plans and privacy policies. Mike has familiarity with a span of state and federal privacy laws, having provided companies with practical regulatory compliance guidance on comprehensive state consumer privacy laws, the Health Insurance Portability and Accountability Act, and the Children’s Online Privacy Protection Act.
