Kevin Rising represents clients in the resolution of a broad range of complex commercial litigation claims. He has served as lead trial counsel in a variety of business disputes, defended scores of consumer class actions, argued in state and federal courts across the country, tried bench and jury claims to verdict, and advocated client positions in arbitration and mediation.

Kevin Rising represents clients in the resolution of a broad range of complex commercial litigation claims. He has served as lead trial counsel in a variety of business disputes, defended scores of consumer class actions, argued in state and federal courts across the country, tried bench and jury claims to verdict, and advocated client positions in arbitration and mediation.

Kevin’s experience includes the resolution of contractual disputes and business torts, partnership and fiduciary litigation, consumer class action defense, multidistrict litigation, product liability and toxic torts. He has an active trial practice and has served as trial counsel for both plaintiffs and defendants in numerous high-stakes jury trials, bench trials and arbitrations.

In addition to serving as a persuasive and dedicated advocate, Kevin is appreciated by clients and colleagues alike for his ability to manage even the most sophisticated, large-scale litigation from start to finish and with an eye toward conserving client resources. For many years, Kevin has served as national counsel for complex product liability cases across the country.

Kevin is the office managing partner for Barnes & Thornburg’s Los Angeles office and partner-in-charge of the firm’s Salt Lake City office.  He also assists with cases in the firm’s San Diego office. 

He is co-chair of the Consumer Class Action Defense Practice Group, the Los Angeles office’s litigation practice administrator, and is one of the original six founding members of that office, having previously served as a partner at Akin Gump Strauss Hauer & Feld LLP.

With nearly two decades of experience, Kevin offers clients deep experience in multiple industries that range from entertainment, healthcare and manufacturing to financial services, technology and telecommunications, retail, and chemical compounds. No matter the client or industry, Kevin focuses on understanding each client’s business and financial objectives, acting as their ambassador in the courtroom, and attaching his credibility to those he represents.

Representative trial experience:

  • Trial counsel for a preeminent amusement park owner and operator during a six-week jury trial in a multimillion dollar product liability action in which the plaintiff alleged that he suffered permanent neurological injuries and disability as a result of riding a roller coaster owned and operated by the client. The case was named one of the annual top defense verdicts in the country by The National Law Journal.
  • Trial counsel for a Silicon Valley software executive defendant in an SEC enforcement action for securities and accounting fraud. The SEC alleged that the executive authorized fraudulent sales transactions and caused his company to improperly recognize tens of millions of dollars in revenue to inflate the stock price. The Daily Journal deemed it one of the annual top 10 defense verdicts in California.
  • Trial counsel for a physician group in partnership litigation. (arbitration)

  • Trial counsel for an internet dating company in multiple class actions throughout the country arising out of a well-publicized data breach.
  • Trial counsel for a national retailer in In re Herbal Supplements Marketing and Sales Practices Litigation MDL.
  • Trial counsel for a premium jean and apparel manufacturers defending class actions in multiple jurisdictions alleging claims under California and other state laws for allegedly mislabeling products as “Made in the USA.”
  • Trial counsel for several national retailers in related cases defending California UCL and CLRA and Magnusson Moss Warranty claims regarding the labeling and performance of store brand dietary supplements.
  • Trial counsel for dietary supplement manufacturers defending California UCL and CLRA claims for false and misleading advertising concerning product warnings and labeling (both California and national classes).
  • Trial counsel for a direct marketing company defending class claims for alleged unlawful recording of phone calls under California Penal Code Sections 632 and 632.7.
