Kelsey Jernigan advises hospitals, health systems, academic medical centers and other healthcare providers on the full range of healthcare regulatory and compliance matters, with a focus on fraud and abuse issues.

Kelsey's work concentrates on healthcare fraud and abuse and compliance matters, including Stark Law and Anti-Kickback Statute issues; hospital contracting with physicians, healthcare providers and vendors; and a range of operational matters, including supply chain and GPO matters; billing, coding compliance audits, repayments; charity care and financial assistance for charitable hospitals. She conducts internal reviews of hospital clients' financial arrangements with physicians and regularly submits disclosures under the Stark Self-Referral Disclosure Protocol. Kelsey analyzes complicated Anti-Kickback Statute and Civil Monetary Penalty matters and has drafted and submitted multiple Advisory Opinion requests to the Office of Inspector General.

Kelsey advises hospitals on Emergency Medical Treatment and Labor Act (EMTALA) issues, from responding to statements of deficiencies and on-site surveyors to representing hospitals before the Quality Improvement Organization and Office of Inspector General. She also counsels healthcare providers through adverse citations and alleged deficiencies in survey matters.

As part of her transactional practices, Kelsey provides strategic counsel in structuring and accomplishing affiliations and transactions between healthcare providers, ranging from acquisitions to joint ventures and complex co-management and contractual affiliations.

Prior to joining Barnes & Thornburg, Kelsey served as co-leader of the Healthcare & FDA practice group of an international law firm.
