Joshua M. Kalb

Josh is a full-service IP lawyer who handles virtually all facets of patent, trademark, false advertising, and trade secret litigation, including day-to-day management of pre-suit investigations, discovery, claim construction, settlement negotiations, summary judgment, trial, arbitration, and appeals before the U.S. Patent and Trademark Office (USPTO) and in federal court.  

Josh has interviewed, deposed, or defended dozens of witnesses in investigations and intellectual property litigations throughout his career, with a particular focus on preparing witnesses for deposition and trial. He has successfully first-chaired a bet-the-company patent arbitration in front of a former federal judge; instituted and defended cancellation and opposition proceedings for multiple clients; prepared, defended, and presented numerous technical experts in patent matters; and represented patent owners in IPR proceedings. Josh has also handled several advertising disputes, including both business-to-business and consumer class action cases.  

Beyond his litigation work, Josh drafts trademark licenses and assignments, prosecutes and enforces trademark portfolios, and counsels clients on IP issues in M&A, equity, and debt transactions, and advises on advertising compliance and substantiation. 

Josh’s breadth of experience across both IP litigation and transactions makes him uniquely suited to offer clients insights and strategies to resolve IP issues, as well as to prevent them from arising in the first place.   

Josh began his career cultivating his skills with Hunton Andrews Kurth LLP. During that time, he spent a year in-house with a Fortune 1000 company advising on regulatory compliance for advertising claims, counseling on FTC and trademark issues, and restructuring advertising compliance process.

Beyond advocating for his client’s interests, Josh enjoys hiking, camping and all things outdoors, as well as playing golf, watching college football, and traveling.
