David Last focuses his practice on enforcement and litigation, including government and internal investigations, white-collar criminal defense of companies and individuals in high-stakes domestic and international enforcement actions, crisis management, and trials with a particular focus on complex cross-border matters, including those involving the Foreign Corrupt Practices Act (FCPA).

David has extensive experience leading complex white collar criminal investigations and litigation matters, drawing on 17 years as a federal prosecutor for the Department of Justice (DOJ), where he investigated and tried matters involving foreign bribery, money laundering, fraud, and tax offenses. Clients regularly call on David to handle and defend some of the most sensitive internal investigations and government enforcement matters. He has worked with clients on a broad spectrum of criminal and civil matters, including representations related to the FCPA, the False Claims Act, cyber fraud, and sanctions.

While at the DOJ, he served as Chief of the FCPA Unit, where he oversaw all FCPA-related investigations, prosecutions, corporate resolutions, trials, and compliance monitorships in the United States. Under his leadership, the FCPA Unit investigated more than 200 matters involving the FCPA, money laundering, wire fraud, and other corruption-related offenses across every significant industry sector and geographic region, including one of the largest coordinated FCPA resolutions in history. In this capacity, David had extensive interactions with domestic regulators such as the SEC, CFTC, and Federal Reserve, and with international law enforcement authorities in the United Kingdom, France, Switzerland, Brazil, and Mexico.

A seasoned trial lawyer, David has personally tried more than 40 cases to verdict. For over a decade, he served as an Assistant U.S. Attorney in Washington, D.C., prosecuting a wide variety of white collar matters, including financial fraud, public corruption, wire fraud, money laundering, bank fraud, tax evasion, and Travel Act violations.

Today he represents public and private companies and individual executives in matters before the DOJ, the SEC, and other regulators, and frequently advises on the development of compliance and integrity programs and in advance of strategic transactions, such as mergers and acquisitions and the formation of joint ventures.
