Brett Clements defends clients in complex product liability, toxic tort, and environmental litigation, including multidistrict litigation, mass torts, and consumer class actions. He counsels clients in the manufacturing, consumer products, automotive, agriculture, health care, and technology industries from case inception through trial.

Brett’s work spans coordinated national litigation as well as individual product liability cases alleging significant losses. He has served on a national coordinating counsel team for a large mass tort defendant, and in the class action context, he defends companies against economic loss claims, particularly those tied to marketing claims and product recalls. He guides clients through complex discovery, major dispositive motions, and trial preparation and, when appropriate, works toward resolution. He has also handled appeals in multiple U.S. Courts of Appeals.

Brett regularly handles depositions of scientific and technical witnesses on complex and novel issues. He also manages all phases of e-discovery, including document collections, negotiation of electronically stored information (ESI) protocols, review strategy, and oversight of productions. He closely follows developments in product liability law and e-discovery, with particular attention to the scientific and technical questions that shape both areas.
