OVERVIEW

With a tell it like it is approach in his life and work, Brandon Miller has centered his labor and employment law practice on the importance of providing clients with clear and open communication, an emphasis on understanding each parties’ interests, and engaging in expectation management.

On a routine basis, Brandon advises and represents employers with issues related to employee overtime, termination, meal and rest breaks, retaliation, misclassification, and unsafe work environment violations, and he provides counsel regarding compensation, contract review, benefits, and retirement. Additionally, he is well-versed in Family Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), California Family Rights Act (CFRA), California Consumer Privacy Act (CCPA), Age Discrimination Employment Act (ADEA), National Labor Relations Act (NLRA), CROWN Act, Occupational Safety and Health Act (OSHA), and other relevant state and federal laws.

In tandem, Brandon drafts mediation briefs, complaints, objections to evidence, and answers to complaints, as well as arbitration agreements, demand letters, claim analysis, motions to dismiss, and settlement conference briefs and other pleadings. He also develops and reviews employer policies and procedures in response to legislative changes.

Raised in a small, family-owned business, Brandon knows firsthand the difficulties and obstacles that many employers face. He leans on that knowledge to counsel employers on ways to reduce turnover, stay apprised of current labor laws, and what proactive steps to take to avoid future litigation and violations. He also guides clients through alternative dispute resolution.

He is consistently seeking to understand core issues affecting his clients’ businesses in order to reach the best and most commonsense solutions.

Brandon has a certificate in alternative dispute resolution, which is pivotal to his skills in negotiating on behalf of his employer clients.

Outside of the office, Brandon enjoys traveling, cooking, golf, collecting records, and most of all, watching the Ohio State Buckeyes win at football.
