The program will feature a nationally recognized independent mediator in a moderated discussion with firm partners. The mediator will share authoritative, practice-tested guidance on selecting the right mediator, timing mediation effectively, preparing the parties, and maximizing the prospects for resolution in complex cases. Participants will acquire substantive legal skills in evaluating case readiness for mediation, structuring comprehensive pre-mediation preparation, and applying advanced negotiation techniques that drive favorable outcomes in high-stakes disputes.

The program will also feature an in-depth case study drawn from a high-stakes, multiparty environmental dispute, examining strategy, preparation, settlement authority, and other critical considerations that shape the outcome of a mediation. Through this interactive case study, participants will gain firsthand experience analyzing the legal and strategic considerations that influence mediation dynamics — including assessing litigation risk, framing settlement positions, managing multiparty negotiations, and advising clients on settlement authority.
