Protecting Privilege in an Era of Self Disclosure

Barnes & Thornburg partner Tony Burba will present at the American Bar Association’s 26th Annual Emerging Issues in Healthcare Law Conference. The panel, “Protecting Privilege in an Era of Self Disclosure,” will discuss the rules of professional responsibility related to attorney confidentiality obligations, the law related to the attorney/client privilege as it relates to both individual and corporate entities, and the scope, and practical implications of the work product doctrine. The session will also address how to balance recent DOJ and HHS guidance on compliance programs and self-disclosure with traditional professional responsibilities related to client confidences, as well as cover practical suggestions for retention of information, Upjohn warnings, and compliance investigations.
