Program Description: In U.S. v. Caronia, the U.S. Court of Appeals in New York vacated a conviction for off-label promotion, ruling that the prosecution violated the defendant's First Amendment rights. Hear a panel discuss the implications of this decision, and an important Supreme Court case from 2011, on the legality of promoting drugs or medical devices for unapproved uses and on related product liability considerations.
