Administrative Law Challenges (Loper Bright, Jarkesy, Corner Post, Kalshi)

Laurian Cristea will lead a panel titled “CFTC and SEC Administrative Law Challenges” at the American Bar Association’s 2025 Derivatives and Futures Law Winter Committee Meeting. Panelists for this session will include Joaquin Gubb (Crypto.com), Daniel Davis (Katten), Jeffrey Steiner (Gibson Dunn), and Alexander Holtan (Holland & Knight).

With a focus on the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC), panelists will examine significant Supreme Court and federal district court cases shaping administrative law, including the implications of overturning Chevron for current and future administrations, the CFTC's preparations for a post-Chevron era, the potential downstream effects of Jarkesy on self-regulatory organizations licensed as designated contract markets and derivatives clearing organizations, and how client behavior has evolved following Chevron's end.
