Few areas of employment law are more complicated and misunderstood than the classification of workers as either independent contractors or employees. The law in this area is complex and the consequences of misclassification can be expensive.
We will discuss and provide an explanation of:
- The traditional common law agency test
- More modern attempts to redefine who is an employee
- Why the distinction matters
