All Eyes on Employee Handbooks – the NLRB and EEOC are Scrutinizing Workplace Policies and Procedures

If you haven’t reviewed your employee handbook lately, this topic is for you. Many employers use, and have used for years, standard or “boilerplate” handbook provisions on general topics such as professionalism, confidentiality, non-disclosure of non-public information, and rules against photography and recording in the workplace. These same employers will likely be surprised that many such provisions are unlawful or problematic under recent rulings from the National Labor Relations Board. Moreover, the U.S. Equal Employment Opportunity Commission is focusing on employment provisions that in its view run afoul of the Americans with Disabilities Act. We will discuss the NLRB’s and EEOC’s take on particular handbook policies and work rules and provide thoughts on how to audit your policies and rules to ensure compliance.

U.S. Supreme Court Rule

The U.S. Supreme Court has several employment-related cases on its docket this term. Come and learn how the Supreme Court ruled in these cases (if the case has already been decided) or what arguments have been presented. Either way, employers must be aware of these new developments.

Illinois Department of Labor: New Regulations

The Illinois Department of Labor has issued new regulations that impact all Illinois employers on a variety of pay practices. These rules were not announced and have received little publicity. This is your chance to learn about them and make certain you are up to date.
